Terms and Conditions of Paid Membership:

These terms of sale (the “Terms”), constitute a
legally binding contract between you (“member” “you” or
“your”) and atFesta.com. (“atFesta”, “atFesta.com”,
“us”, “we”, or “our”) that governs your purchase of
any and all products and/or services (collectively, “Item(s)”) made
on or through the atFesta.com website, currently located at https://atFesta.com/
(including any sub-domains, subpages, directories, or mobile versions of the
website), and all atFesta mobile applications and online services (collectively
the “Site”).

Membership

Your membership will continue and automatically renew until
terminated. To avoid being billed for the next billing cycle, you must cancel
your subscription before it renews. (see “Cancellation” below).

atFesta.com is not responsible for any disagreement between
clients and our members.

Billing and Cancellation

Billing Cycle

The membership fee for the atFesta service, along with any
additional charges such as taxes and possible transaction fees, will be billed
to your Payment Method on the specific billing date indicated on your ‘Dashboard/My Listing’
page. The length of your billing cycle depends on the type of membership you
select when signing up for the service. Membership fees are fully earned upon
payment. In some cases, your payment date may change, for example, if your
Payment Method fails to settle successfully or if your membership begins on a
day not present in a given month. We may authorize your Payment Method in
anticipation of membership or service-related charges, including authorizing it
for up to approximately one month of service at the time of registration.

Payment Methods

You authorize atFesta to charge any Payment Method
associated with your account if your primary Payment Method is declined or
unavailable for payment of your subscription fee. You remain responsible for
any uncollected amounts. If a payment is not successfully processed due to
issues such as expiration, insufficient funds, or other reasons, and you do not
cancel your account, we may suspend your access to the service until a valid
Payment Method is successfully charged. Some Payment Methods may incur
additional fees, such as foreign transaction fees or other charges related to
the processing of your payment. Please check with your Payment Method provider
for details.

Changes to the Price and Subscription Plans

We reserve the right to change our subscription plans or
adjust pricing for our service or any of its components at any time and in any
manner we determine at our sole discretion. Except as expressly provided in
these Terms of Use, any changes in pricing or your subscription plan will take
effect after we notify you.

Cancellation

You can cancel your atFesta subscription at any time. To do
so, go to the “Dashboard/My Listing” page on our website and follow the
cancellation instructions. To check when your account will close, click
“Billing details” on the “Dashboard/My Listing” page. If you signed up
for atFesta using a third-party account as your payment method and wish to
cancel, you may need to cancel through that third party, for example, by visiting
your account with the applicable third party and turning off auto-renew or
unsubscribing from the atFesta service. You can also find billing information
about your atFesta subscription by visiting your account with the applicable
third party.

No Refund

Payments are nonrefundable and there are no refunds or
credits for partially used periods.

You agree to use the atFesta services, including all
features and functionalities associated with them, in accordance with all
applicable laws, rules, regulations, and other restrictions on the use of the
service or its content. Except as explicitly authorized in these Terms of Use,
you agree not to archive, download, reproduce, modify, display, perform,
publish, license, create derivative works from, offer for sale, or use any
content and information contained on or obtained through the atFesta service.
You also agree not to circumvent, remove, alter, deactivate, degrade, or thwart
any content protections in the atFesta service; use any AI, bot, robot, spider,
scraper, or other automated means to access the atFesta service; decompile,
reverse engineer, or disassemble any software, products, or processes
accessible through the atFesta service; insert any code or products, or
manipulate the content of the atFesta service in any way; or use any data
mining, data gathering, or extraction methods. Additionally, you agree not to
upload, post, email, or otherwise send or transmit any material designed to
interrupt, destroy, or limit the functionality of any computer software,
hardware, or telecommunications equipment associated with the atFesta service,
including any software viruses or other computer code, files, or programs. We
may terminate or restrict your use of our service if you violate these Terms of
Use or engage in illegal or fraudulent use of the service.

Prohibited Conduct

You agree not to
engage in any of the following prohibited conduct:

1.       Deleting copyright or other proprietary rights
markings on atFesta or other users’ submissions.

2.       Making unsolicited offers, advertisements,
proposals, or sending junk mail or spam to other users of atFesta. This
includes, but is not limited to, unsolicited advertising, promotional
materials, or other solicitation material; bulk mailing of commercial advertising;
chain mail; informational announcements; charity requests; and petitions for
signatures.

3.       Using atFesta in violation of any local,
state, national, or international law, including, without limitation, laws
governing intellectual property and other proprietary rights, as well as data
protection and privacy, or posting, uploading, or distributing any defamatory,
libelous, or inaccurate user submissions or other content

4.
Defame, harass, abuse, threaten, or defraud
users of atFesta, or post, upload, or distribute any content that is unlawful
or otherwise inappropriate; collect or attempt to collect personal information
about users or third parties without their consent; or use the content on
atFesta for any commercial purpose, it being understood that the content
available on atFesta is for personal, non-commercial use only.

5.
Rent, lease, loan, sell, resell, sublicense,
distribute, or otherwise transfer the subscription granted under these Terms or
any materials (as defined below).

6.
Impersonate any person or entity, falsely claim
an affiliation with any person or entity, access atFesta accounts of others
without permission, forge another person’s digital signature, misrepresent the
source, identity, or content of information transmitted via atFesta, or perform
any other similar fraudulent activity.

7.
Hack, remove, circumvent, disable, damage, or
otherwise interfere with security-related features of atFesta or user
submissions; features that prevent or restrict use or copying of any content
accessible through atFesta; or features that enforce limitations on the use of
atFesta or user submissions; or intentionally interfere with or damage the
operation of atFesta or any user’s enjoyment of it by any means, including
uploading or otherwise disseminating viruses, adware, spyware, worms, or other
malicious code.

8.
Reverse engineer, decompile, disassemble, or
otherwise attempt to discover the source code of atFesta or any part thereof,
except and only to the extent that such activity is expressly permitted by
applicable law notwithstanding this limitation.

9.
Modify, adapt, translate, or create derivative
works based upon atFesta or any part thereof, except and only to the extent
that such activity is expressly permitted by these Terms or applicable law
notwithstanding this limitation.

10.
Remove, obscure, block, hide, or otherwise alter
the display of any advertising (or any parts or aspects thereof), atFesta brand
elements, including logos, trademarks, service marks, or other materials
displayed by atFesta in any manner whatsoever, regardless of your use of the
embedding functionality of atFesta to display authorized content on your own or
third-party sites.

General Terms of Use:

Membership Eligibility: By registering for our paid
membership, you confirm that you are at least 18 years old and legally capable
of entering into a binding contract.

Payment: Upon subscribing to our paid membership, you agree
to pay the specified membership fee as outlined on our website. Payments are
due in advance and are non-refundable.

Automatic Renewal: Your membership will automatically renew
at the end of each billing cycle unless you cancel it before the renewal date.
You authorize us to charge the applicable membership fee to your chosen payment
method on file.

Cancellation: You may cancel your membership at any time by
accessing your account settings on our website or by contacting our customer
support team. Upon cancellation, you will retain access to the paid features
until the end of the current billing period.

Account Security: You are responsible for maintaining the
confidentiality of your account credentials and for all activities that occur
under your membership account.

Prohibited Activities: Members agree not to engage in any
unlawful, abusive, or disruptive behavior while using our website or membership
services.

Content Usage: All content provided to paid members is for
personal use only and may not be shared, distributed, or reproduced without
prior authorization.

Termination: We reserve the right to terminate or suspend
your membership at any time for violation of these terms or for any other
reason deemed appropriate by us.

Modification of Terms: We reserve the right to update or
modify these terms and conditions at any time. Notification of changes will be
provided, and continued use of the membership constitutes acceptance of the
updated terms.

Limitation of Liability: We are not liable for any damages,
losses, or liabilities incurred as a result of using our website or membership
services.

By subscribing to our paid membership, you acknowledge that
you have read, understood, and agree to abide by these Terms and Conditions.
